MAKING A BEQUEST

 

Thank you for your interest in including a bequest to the Epilepsy Foundation of Victoria in your will. It is important that the bequest is worded correctly and the following is recommended as a guide. You may wish to give this wording to the legal practitioner who is preparing your will.

It is important when making or altering your will to remember to use our legal name – Epilepsy Foundation of Victoria Inc. For your assistance, it is suggested the following form of bequest be used when nominating the Epilepsy Foundation as a beneficiary of your will.

I give, devise and bequeath to the Epilepsy Foundation of Victoria Inc free from all duties, (1* please specify) to be applied (2* to such objects as the Committee of Management shall from time to time direct) and declare that the receipt of the Treasurer or other proper officer for the time being of the said Epilepsy Foundation of Victoria Inc shall be sufficient discharge to my executors.

1. Where it says “please specify”, you could include:

  • A percentage of your estate
  • The whole residue of your estate (usually only if you have no children or other dependants)
  • A specified sum of money
  • A specific item (such as property or shares)

The Epilepsy Foundation of Victoria has been endorsed by the Australian Taxation Office as a deductible gift recipient (DGR) and an income tax exempt charitable entity (ITEC) for income and capital gains tax purposes.

NOTE
If you wish to make your bequest for a specific purpose or if you wish to exclude any particular activity we suggest the following

2. Where it says “to such objects as the Committee of Management shall from time to time direct”, you could change to:

  • to such objects as the Committee of Management shall from time to time direct excepting ______ (please be specific, as an example, if you do not wish to fund medical research use the full term not just research as this may prevent social or consumer research)
  • to the support of __________________  (in this case try not to be too detailed as our programs take many forms and your death may be many years in the future when needs may be different. As an example, if your wish is to support children with epilepsy giving the funds just for children’s camps may mean that we cannot support a new program at the time that may be better for the children. Our suggestion would be “to the support of children with epilepsy”)
